Checks and notices that you may have received this week (mailed December 11, 2008) relating to a class action settlement against Wachovia Bank are legitimate and were sent pursuant to court orders. If you require further confirmation for a bank to accept the check you may refer the bank to the website of the Office of the Comptroller of the Currency, a federal agency that regulates banks, which has a description of the settlement in a press release. The main number of the Office of the Comptroller of the Currency is 202-874-5000. You can also obtain further confirmation at the press release on the website of the United States Attorneys’ Office for the Eastern District of Pennsylvania, a part of the United States Justice Department. Similar confirmation can be obtained at the website of Wachovia Bank.
Carefully read the notice and all the documents that came with it. The notice describes opportunities you may have to obtain additional compensation for certain bank charges you may have incurred as a result of the conduct that was the subject of the lawsuit. If you have questions, you should go to the following web site set up especially for people like you: http://www.restitutionpayment.com. There is also a toll-free number you can call. It is 1-866-680-6659.
Because of the large number of checks sent, it has been difficult to reach the toll free number. The checks can be deposited over a period of 90 days from the date printed on your check and we suggest that if you have not been able to reach a person at the toll free number, that you wait a few days and try again when the number of calls will have decreased.
If a bank or check cashing service destroyed or voided a check you received, please write to the Claims Administrator concerning the destruction of the check. Please include your claim number, if you still have it. Also include the name and address to which the notice and check were directed. The Claims Administrator’s address is:
