Consumer Class Actions

Lawyers from the firm have been involved in a wide variety of class action cases brought on behalf of consumers. The firm recently concluded one of the largest consumer class action settlements ever in Faloney v. Wachovia Bank, NA. The firm recovered full damages for a class of over 800,000 victims of telemarketing fraud. Class members were sent checks totaling over $150 million directly without the need for the filing of claim forms and were also provided the opportunity to file claims for additional recoveries for any bank charges they had incurred as a result of the violation.

In Cullen v. Whitman Medical Corp., 197 F.R.D. 136 (E.D. Pa. 2000), they obtained what was until then the largest recovery ever obtained in a class action against a trade school which had provided deficient education, in that case in the field of ultrasound.

 In Robinson v. Countrywide Credit Industries, 1997 WL 634502 (E.D. Pa. 1997), lawyers from the firm obtained certification of a class of persons who were subjected to exorbitant homeowners insurance charges by mortgage companies. In In re Marine Midland Motor Vehicle Leasing Litigation, 155 F.R.D. 416 (W.D.N.Y. 1994), lawyers from the firm obtained restitution for a class of automobile lessees who had been overcharged on their leases and had been charged phantom excess wear and tear charges at the conclusion of their leases.

The firm has been representing Pennsylvania consumers in class actions against several payday loan companies, alleging that payday lending violates Pennsylvania usury laws.  Partnering with Community Legal Services of Philadelphia, the firm successfully handled a class action against Frascella Enterprises, Inc., doing business as "Cash Today."  After the defendants filed bankruptcy and removed the case to bankruptcy court, and after extensive litigation concerning a class-action waiver in the loan contracts, 349 B.R. 421 (Bankr. E.D. Pa. 2006) and concerning an earlier settlement that the defendants repudiated, 388 B.R. 619 (2008), the case recently settled and produced a distribution to roughly 9,000 consumers.  The firm is also representing Pennsylvania consumers in pending class actions against the nation's largest payday loan company, Johnson v.
