Judah Labovitz has specialized in complex commercial litigation since his graduation magna cum laude from the University of Pennsylvania Law School in 1963, where he has elected to the Order of the Coif. Judah’s cases have included both prosecution and defense of antitrust and securities class actions, disputes relating to international letters of credit, complex contract and real estate disputes, and claims of unfair competition. Judah was co-lead counsel in the Domestic Air Transportation Antitrust Litigation, and successfully argued for certification of a class of all airline ticket purchasers, one of the largest classes ever certified in an antitrust case.

Judah has authored articles and treatise chapters on antitrust law, including the application of antitrust law to health care professionals and health care institutions. He has also appeared as an amicus before the Pennsylvania Supreme Court to challenge the constitutionality of the death penalty as a matter of Pennsylvania constitutional law and in litigation arising under the Establishment Clause of the First Amendment of the United States Constitution.

Representative cases in which Judah appeared as counsel include Susquehanna Capital Group v. Rite Aide Corp., 2002 WL 31528490 (E.D. Pa. 2002) (summary judgment for defendant in tender offer case); Leonard A. Feinberg, Inc. v. Central Asia Capital Corp., 974 F. Supp. 822 (E.D. Pa. 1997) (sustaining Rico cause of action against Hong Kong bank with respect to international letter of credit); In re Domestic Air Transportation Antitrust Litigation, 137 F.R.D. 677 (N.D. Ga. 1991) (certification of class of airline ticket purchasers); Houser v. Fox Theatre Management Corp., 845 F.2d 1225 (3d Cir. 1988) (upholding summary judgment for theatre operator in antitrust action relating to motion picture distribution); Wool v. Tandem Computers, Inc., (9th Cir. 1987) (upholding standing of in and out trader to maintain 10b-5 class action).

Judah has been active both in Philadelphia and nationally in organizations promoting protecting of constitutional liberties and community relations. He served as President of the Jewish Community Relations Council of Philadelphia, Vice Chair of the Jewish Council for Public Affairs and currently is a member of the Board of the Jewish Social Policy Action Network.
