LGD Files National Class Action Challenging Abusive Collection of “Zombie” Second Mortgages by Shellpoint Mortgage Servicing

Langer Grogan & Diver, P.C. is lead counsel in a class action against Shellpoint Mortgage Servicing, a division of NewRez, one of the nation’s largest mortgage servicers. The case, Colbert et al. v. New Rez, is seeking millions of dollars in damages for the thousands of homeowners victimized by a “zombie” second-mortgage scheme, in which long-dormant second mortgages that were originated during the lending frenzy that produced the 2008 financial collapse have come back to life in the hands of debt buyers. The suit alleges that Shellpoint is using foreclosure threats to collect previously waived mortgage interest that has been retroactively assessed.
